Kaiden N. Boerner, 20, of Fairmont received a statutory stay of adjudication on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, one year supervised probation, sentence to service five days for indeterminate, contact probation officer as directed, complete chemical assessment, follow all recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, take medications in the prescribed dosage and frequency, maintain employment, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charges of contributing to the delinquency of a child or status as petty offender, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.

Additional charges of fifth-degree controlled substance possession-not small amount of marijuana, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.

Eber N. Juarez-Ramirez, 43, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 87 days for one year, credit for time served three days, one year unsupervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, no same or similar. Additional charge of operate motor vehicle while under the influence of alcohol was dismissed.

Betty A. Mercado, 35, of St. Peter was convicted on a felony charge of theft-take/use/transfer movable property without consent; fined $100, sentenced to jail 72 days, credit for time served 72 days, five years supervised probation, sentence to service 10 days for indeterminate, contact probation officer as directed, pay restitution if filed within 30 days, enter and successfully complete drug court in the county of residence, successfully complete current inpatient treatment and follow all recommendations for care and aftercare, complete chemical assessment as advised by probation agent, complete diagnostic assessment if advised by probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, take medications in the prescribed dosage and frequency, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional felony charges of theft-take/use/transfer movable property without consent, and aid and abet theft-take/use/transfer movable property without consent, were both dismissed.
