Yesmari Rojas Rosado, 27, of Truman received a stay of imposition pursuant to Minnesota statutes on a felony charge of threats of violence; fined $785, sentenced to jail four days, credit for time served four days, three years supervised probation, complete chemical assessment and follow recommendations of evaluation, complete Spanish speaking programming with Stages for Change as directed by agent, can receive credit for any out-of-pocket expenses, no threats of violence or violent behavior, no contact with victim(s), no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, contact probation officer as directed, attend English as a Second Language through CER as directed by agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote or vote until discharged from probation and civil rights are fully restored. One additional felony charge of second-degree assault with a dangerous weapon, and a misdemeanor charge of endanger child-situation could cause harm or death, were both dismissed.

Aduk J. Malueth, 20, of Le Mars, Iowa was convicted of speeding; fined $145. Also convicted of no Minnesota drivers license; fined $100.

Benito Briseno Jr., 66, of Fairmont was convicted of driving after cancellation-inimical to public safety; fined $285, sentenced to jail 365 days, stayed 365 days for one year, one year unsupervised probation, no same or similar, no drivers license violations. Additional charge of uninsured vehicle-driver violation was dismissed.

Wilfido Chavez-Martin, 29, of Fairmont was convicted on a felony charge of first-degree driving while impaired-alcohol concentration 0.08 within two hours; fined $1,185, commit to Commissioner of Corrections 36 months, stayed for five years, sentenced to jail 180 days, credit for time served 12 days, can do work release if eligible, sentence can be staggered over 3.5 years, five years supervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession, random testing, contact probation officer as directed, no driving without valid drivers license, provide proof of insurance, no same or similar, attend MADD impact panel if recommended by agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote or vote until discharged from probation and civil rights are fully restored. One additional felony charge of first-degree operate motor vehicle while under the influence of alcohol, and a misdemeanor charge of driving after cancellation-inimical to public safety, were both dismissed.

Lupe D. Gersdorf-Koons, 48, of Sioux Falls, S.D. was convicted on a felony charge of fleeing a peace officer in a motor vehicle; fined $173.99, restitution $98.99, commit to Commissioner of Corrections 17 months, give a DNA sample when directed, pay restitution of $98.99. One additional felony charge of fifth-degree controlled substance possession-not small amount of marijuana, and misdemeanor charges of fleeing a peace officer by a means other than a motor vehicle, receiving stolen property, and possession of drug paraphernalia-use prohibited, were all dismissed.

Christian B. Hugget-Lucio, 20, of Fairmont was convicted of disorderly conduct-offensive/abusive/noisy/obscene; fined $285, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, remain law-abiding, no same or similar.
