Zander J. Helmers, 19, of Sherburn received a stay of adjudication on a felony charge of first-degree criminal sex conduct-penetration -victim under 16 with multiple acts over time; 10 years supervised probation, sentence to service 20 days for indeterminate, contact probation officer as directed, enter into, cooperate with and successfully complete outpatient sex offender treatment as arranged by agent, submit to polygraph examinations as directed, no direct or indirect contact with victim and victim’s immediate family, don’t possess/use any pornographic/sexually explicit material, don’t use any phone sex lines, dating services, social networks or enter strip clubs or adult bookstores or other business where the primary source of business is adult entertainment, must disclose all electronic devices and all electronic devices to agent subject to monitoring at agent’s discretion, no unsupervised contact with persons under age 18 and if contact is approved, the individual(s) to provide the supervision must also be pre-approved by probation and treatment, no unsupervised contact with vulnerable adults and if contact is approved, the individual(s) to provide the supervision must also be pre-approved by probation and treatment, no use of social media/dating websites unless approved by agent, psychological-sexual evaluation and follow all recommendations, assessor must be approved by probation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, restitution reserved, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charges of first-degree criminal sex conduct-penetration-fear of great bodily harm, first-degree criminal sex conduct-penetration-armed with dangerous weapon, first-degree criminal sex conduct-forced penetration-victim under 16 significant relationship, and fourth-degree criminal sex conduct-victim under 13 and actor not older than 36, were all dismissed.
Kiley M. Ziemer, 28, of Fairmont was convicted of operate motor vehicle while under the influence of alcohol; fined $885, sentenced to jail 364 days, stayed 334 days for two years, credit for time served 11 days, must serve the remaining 19 days on electronic home monitoring with alco-sensor at defendant’s expense, work release is granted, two years supervised probation, contact probation officer as directed, complete post-sentence investigation as directed by probation agent, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, no same or similar, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition or explosives if prohibited by law. Additional charge of driving while impaired-alcohol concentration 0.08 within two hours was dismissed.
Ellyn M. Erickson, 70, of Madelia was convicted of driving without a valid drivers license for vehicle class or type; fined $135, one year unsupervised probation, restitution reserved for 30 days, no same or similar. Additional charge of driver involved fails to stop for collision of driven or unattended vehicle was dismissed.
Wendy X. Sanchez Cortez, 23, of Fairmont had a charge of disorderly conduct-offensive/abusive/boisterous/noisy/obscene continued for dismissal; fined $100, six months unsupervised probation, no same or similar.
Dustin A. Sweeney, 39, of Fairmont was convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, don’t enter Fairmont Walmart during the term of probation, no same or similar.
Marshall E. Kieffer, 20, of Altura was convicted of driving after suspension; fined $285. Also convicted of suspended object; fined $40. Also convicted of front and rear license plates required; fined $30.
Delwin G. Smith, 63, of Vernon Center received a stay of adjudication on a charge of passing on right when prohibited; fined $135, six months unsupervised probation, no same or similar.
