Chad E. Whelan, 33, of Bricelyn was convicted on a felony charge of first-degree driving while impaired-within 10 years of 3 or more qualified impaired driving incidents; fined $940, commit to Commissioner of Corrections 36 months, stayed for five years, sentenced to jail 180 days, credit for time served 20 days, may serve on EHM with alcohol sensor at defendant’s expense, five years supervised probation, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, complete alcohol monitoring for a minimum of 30 consecutive days, attend and complete MADD impact panel within 60 days, complete cognitive skill training as assigned by agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote or vote until discharged from probation and civil rights are fully restored. Additional charge of driving after cancellation-inimical to public safety was dismissed.

Danny R. Hummer, 67, of Wells was convicted of fourth-degree driving while impaired; fined $410, sentenced to jail 90 days, stayed 87 days for one year, credit for time served three days, one year supervised probation, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Also received a stay of adjudication on a charge of obstruct legal process-interfere with peace officer; sentenced to jail three days, credit for time served three days, one year supervised probation, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no same or similar. Additional charge of third-degree driving while impaired-refuse to submit to chemical test was dismissed.

Cody A. Hernandez, 28, of Winnebago received a stay of adjudication on a charge of school bus violation-fail to stop; fined $260, six months unsupervised monitoring without conviction, six months no same or similar.

Dylan J. Bartel, 31, of Albert Lea was convicted of driving after revocation; fined $285. Also convicted of driver fails to stop for stop sign; fined $50.
