Benjamin E. Blum, 42, of Blue Earth was convicted of driving while impaired-refuse to submit to chemical test-breath or test refusal or failure; fined $885, sentenced to jail 365 days, stayed 335 days for two years, credit for time served 11 days, two years supervised probation, can serve remaining 19 days on EHM with alco-sensor at defendant’s own expense, contact probation officer as directed, attend MADD impact panel, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charges of operate motor vehicle while under the influence of alcohol, possess/sale small amount of marijuana-no remuneration, and possession of drug paraphernalia-use or possession prohibited, were all dismissed.

Patrick M. Creech, 38, of Fairmont was convicted on a felony charge of firearm violation-convicted crime of violence; commit to Commissioner of Corrections 45 months, give a DNA sample when directed. Also convicted on a felony charge of theft-take/use/transfer movable property without consent; fined $2,994.40, restitution $2,919.40, commit to Commissioner of Corrections 21 months, give a DNA sample when directed, pay restitution. Additional felony charges of firearm violation-convicted crime of violence, theft-take/use/transfer movable property without consent, machine guns and short-barreled shotguns-acts prohibited, fifth-degree controlled substance possession-not small amount of marijuana, and misdemeanor charges of giving peace officer false name of another person, driving after revocation, and fail to deliver or mail certificate of title to department within timeframe specified, were all dismissed.

Amy M. Wiebe, 40, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of financial transaction card fraud-use without consent; fined $685, sentenced to jail 365 days, stayed 335 days for five years, may serve on work release if eligible, five years supervised probation, contact probation officer as directed, follow all chemical dependency treatment aftercare recommendations indicated in the discharge report, attend mental health therapy until successfully discharged by therapist, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, take medications in the prescribed dosage and frequency, no direct or indirect contact with the victim or victim’s family members, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional charge of identity theft-transfers/possesses/uses identity of other person was dismissed.

Katherine A. Green, 30, of Welcome was convicted of second-degree controlled substance possession-25 grams or more; fined $100, commit to Commissioner of Corrections 48 months, stayed for five years, sentenced to jail 120 days, credit for time served 53 days, may do STS while in custody if eligible, five years supervised probation, sentence to service 20 days for indeterminate, contact probation officer as directed, comply with all recommendations of the chemical dependency assessment and if inpatient treatment is recommended to be transported by MC Sheriff’s Dept., attend individual counseling until successfully discharged by therapist, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, take medications in the prescribed dosage and frequency, cognitive skill training if requested by probation agent, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional felony charges of first-degree controlled substance sales-17 grams or more within 90-day period, and first-degree controlled substance sales-aid and abet sales of 17 grams or more within 90-day period, were both dismissed.
