Juan A. Rubio, 20, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of third-degree criminal sex conduct-victim 13-15 and actor over 24; fined $75, sentenced to jail 30 days, serve with work release if eligible, 15 years supervised probation, sentence to service 10 days for indeterminate, obtain permission from agent before leaving the state, cooperate with and successfully complete outpatient sex offender treatment as arranged by agent, submit to polygraph examinations as directed, no direct or indirect contact with victim or family, no use or possession of pornography or sexually explicit material, don’t use any phone sex lines, dating services, social networks or enter any strip clubs or adult book stores or any other business where the primary source of business is adult entertainment, comply with predatory offender registration including photographing, fingerprinting and DNA, disclose all electronic devices to agent, no unsupervised contact with vulnerable adults and if so must be pre-approved by probation and treatment, no unsupervised contact with persons under the age of 18 but may have contact and reside with minor sister, complete a psycho-sexual assessment and follow all recommendations, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives.

David I. Denzer, 29, of Le Sueur received a stay of imposition pursuant to Minnesota statutes on a felony charge of third-degree controlled substance possession-10 grams or more (other than heroin); fined $1,085, sentenced to jail 60 days, credit for time served three days, serve as home detention/electronic monitoring if eligible, five years supervised probation, complete chemical assessment within 90 days of sentencing, and follow all recommendations of evaluation for both care and aftercare, obtain permission from agent before leaving the state, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, remain law-abiding, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional felony charges of second-degree controlled substance possession-10 grams or more within a 90 day period, and conspiracy to commit second-degree controlled substance crime, were both dismissed.

Cody W. Diekmann, 28, of St. Cloud was convicted of second-degree controlled substance possession-25 grams or more; fined $160, commit to Commissioner of Corrections 90 months, give a DNA sample when directed. Additional felony charge of first-degree controlled substance possession-50 grams or more was dismissed.
