Joseph A. Desmarais Jr., 39, of Wells was convicted on a felony charge of predatory offender-knowingly commits act or fails to fulfill registration requirement; fined $585, commit to Commissioner of Corrections 24 months, stayed three years, sentenced to jail three days, sentence to service 40 hours for indeterminate, no mood-altering chemicals, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, predatory offender registration required and comply with all requirements, complete outpatient treatment with Fountain Centers and follow all aftercare recommendations, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if been charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional felony charge of predatory offender-intentionally provides false information was dismissed.

Jeffrey S. Schellenberg, 28, of Albert Lea received a stay of imposition pursuant to Minnesota statutes on a felony charge of third-degree assault-substantial bodily harm; fined $22,575.76, restitution $22,490.76, sentenced to jail nine days, credit for time served two days, may serve jail time on weekends, serve as work release if eligible, Huber is granted if qualified, three years supervised probation, sentence to service 40 hours for indeterminate, pay monthly restitution payments of $100, cognitive skill training as directed by agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, complete chemical assessment within 30 days and follow all recommendations, no contact with victim(s), don’t enter bars or liquor stores or any establishment where alcohol is the primary source of income, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored.
