Matthew P. Holtz Jr., 31, of Fairmont was convicted on a felony charge of domestic assault; fined $467, restitution $467, commit to Commissioner of Corrections 27 months, supply DNA sample. Also convicted of fifth-degree controlled substance possession-not small amount of marijuana; sentenced to jail 364 days, credit for time served 64 days, concurrent with two other cases. An additional felony charge of second-degree assault with a dangerous weapon-substantial bodily harm was dismissed.

Santos Perez Ponce, 28, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $10,338.56, restitution $10,313.56, sentenced to jail 364 days, stayed 360 days for two years, credit for time served four days, two years supervised probation, sentence to service 15 days for indeterminate, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, pay restitution by working with probation agent to set up regular monthly payments to Martin County Court Administrator, cooperate with any post-sentence investigation required by probation, don’t drive without a valid drivers license, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, attend MADD impact panel, obtain employment, maintain employment, no same or similar, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives.
