Emilie A. Luedke, 32, of Fairmont had a felony charge of domestic assault by strangulation continued for dismissal; fined $100, one year unsupervised monitoring without conviction, cooperate with current child protection case, no same or similar. Also had a charge of malicious punishment of a child continued for dismissal; fined $100, one year unsupervised monitoring without conviction, cooperate with current child protection case, no same or similar. Also had a charge of domestic assault-intentionally attempts to inflict bodily harm on another continued for dismissal; fined $100, one year unsupervised monitoring without conviction, cooperate with current child protection case, no same or similar.

Fabian Rivera Gonzalez, 30, of Fairmont was convicted of driving after cancellation-inimical to public safety; fined $485, sentenced to jail 365 days, stayed 305 days for two years, sentence to be served on EHM, work release granted if eligible, concurrent with other case, two years supervised probation, contact probation officer as directed, complete an updated comprehensive assessment if recommended by probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law.

Luis R. Rodriguez Burgos, 28, of Fairmont was convicted on a felony charge of fleeing a peace officer in a motor vehicle; fined $685, commit to Commissioner of Corrections 15 months, stayed three years, sentenced to jail 90 days, credit for time served 21 days, STS is granted, three years supervised probation, contact probation officer as directed, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote or vote until discharged from probation and civil rights are fully restored. Additional charges of obstruct legal process-interfere with peace officer, driving after revocation, reckless driving-drives consciously disregarding a substantial or unjustifiable risk, and careless driving-operate any vehicle carelessly on street or highway, were all dismissed.

Marissa N. Theobald, 25, of Fairmont was convicted of neglect of a child-likely substantial harm to physical/emotional health; fined $485, sentenced to jail 365 days, stayed 365 days for two years, two years supervised probation, contact probation officer as directed, complete diagnostic assessment if recommended by probation agent, follow all aspects regarding current open child protection case, no same or similar, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law.

Brndon J. Phillips, 44, of Stanton, Mo. had a charge of speeding continued for dismissal; fined $125, six months unsupervised monitoring without conviction, no same or similar.
