Jamie L. Hatfield, 34, of Lewisville was convicted on a felony charge of third-degree controlled substance possession-10 grams or more other than heroin; fined $1,085, commit to Commissioner of Corrections 27 months, stayed five years, sentenced to jail 90 days, credit for time served 43 days, remain in custody until treatment facility picks defendant up, five years supervised probation, sentence to service 40 hours for indeterminate, contact probation officer as directed, obtain permission from agent before leaving the state, attend and successfully complete a residential chemical dependency treatment program and follow all recommendations, attend and successfully complete a diagnostic evaluation and follow all recommendations, attend and successfully complete the cognitive skills program/thinking for a change if deemed appropriate by probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, any diluted sample or refusal to submit will be considered positive and a violation of probation, pay restitution of $95.98, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted of obstruct legal process-interfere with peace officer; sentenced to jail 90 days, credit for time served 43 days. An additional felony charge of first-degree controlled substance sales-17 grams or more within a 90-day period, and a misdemeanor charge of fleeing a peace officer by means other than a motor vehicle, were both dismissed.
Roy W. Helton, 33, of Fairmont was convicted on a felony charge of fourth-degree assault of a peace officer-throws/transfers bodily fluids or feces at or onto officer; fined $1,210, commit to Commissioner of Corrections 366 days, stayed three years, sentenced to jail 90 days, credit for time served 25 days, three years supervised probation, contact probation officer as directed, complete a chemical dependency assessment and abide by all recommendations including aftercare, participate in individual counseling, do not end counseling without prior approval from agent, no assaultive or threatening behaviors, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional charges of fourth-degree assault of a peace officer-physically assaults, obstruct legal process-interfere with peace officer, and disorderly conduct-offensive/abusive/boisterous/noisy/obscene, were all dismissed.
Kayla M. Waalen, 33, of Osceola, Wis. received a statutory stay of adjudication on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $885, sentenced to jail six days, credit for time served six days, five years supervised probation, contact probation officer as directed, follow all recommendations of most recent chemical dependency evaluation including any treatment or aftercare recommendations and provide a copy to probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, remain law-abiding, work with agent to get probation transferred to Wisconsin, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives is prohibited by law. Additional felony charges of third-degree controlled substance possession-in school/park/public housing zone, aiding and offender to avoid arrest-harboring or concealing, and a misdemeanor charge of possession of drug paraphernalia-use or possession prohibited, were all dismissed.
