Cody J. Opheim, 32, of Fairmont was convicted on a felony charge of domestic assault; fined $1,085, commit to Commissioner of Corrections 18 months, stayed five years, sentenced to jail 60 days, credit for time served 18 days, may be furloughed after 12/9/20 to be admitted to treatment facility and will not have to return to serve balance of 60 days if successfully completes the treatment program, five years supervised probation, follow all conditions set forth in the probation agreement, complete chemical assessment and abide by the recommendations for care and aftercare, complete domestic abuse batterer’s intervention program, no threats of violence, no acts of violence, threats or intimidation, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, complete psychological evaluation and abide by recommendations for care and aftercare, participate with mental health case management, follow all current and/or future Orders for Protection and/or Domestic No Contact orders, don’t carry knives unless specifically needed for employment and cleared by agent, cognitive skill training if recommended by agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign all releases of information, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Tesch, 41, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of domestic assault; fined $1,085, sentenced to jail 20 days, credit for time served 20 days, five years supervised probation, follow all conditions set forth in the probation agreement, chemical dependency evaluation/treatment and follow all recommendations for care and aftercare, successfully complete domestic abuse batterer’s intervention program and follow all recommendations for care and aftercare, report to agent as directed within 24 hours of sentencing, no contact with victim(s), no assault, refrain from any assaultive abuse or any other violent behaviors including harassment, stalking or threats of violence, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign all releases of information, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored.

Hannah C. Nelson, 22, of New Ulm was convicted of possession of drug paraphernalia; fined $135. Also convicted of marijuana in motor vehicle-less than 1.4 grams; fined $50.
