Man faces felony charge

FAIRMONT — A Rochester man is facing a felony charge in Martin County. Dustin John Vogel, 27, has been charged with criminal sexual conduct in the third degree, which carries a maximum penalty of five years in prison and a $30,000 fine.

According to the complaint:

On March 17, 2021, a Fairmont Police officer interviewed a 23-year-old female who stated that in February 2010, she met Man faces felony charge on Facebook. They began communicating with each other and met in person on February 21, 2010. They began dating. In March of 2010, the woman and Vogel engaged in sexual contact.

They continued to meet on a weekly basis from February 2010 through May 2010. In the summer of 2010, they would see each other almost on a daily basis. They dated for approximately two and a half years, ending the relationship on July 2012.

The woman stated that approximately 99 percent of the time she had contact with Vogel, they had sexual contact. She stated this this occurred in numerous locations, including the Fairmont movie theater, Flying Goose Campground, City of Truman parks, Vogel’s residence in Truman, and at her residence in Fairmont, all of which locations are in Martin County.

She stated that after she and Vogel broke up, they dated again in October 2012 for approximately one week, during which she had sexual contact with Vogel in his dorm room in Mankato. During all of the sexual encounters, the woman resided in Fairmont.

On March 20, 2021, the officer interviewed Vogel by phone. Vogel claimed that he began dating the woman sometime in 2010. He stated that they had sexual contact, all of which was consensual.
