Man facing felony counts

FAIRMONT — A Trimont man is facing felony charges in Martin County.

Terry Jay Schulz, 40, has been charged with criminal sexual conduct in the first degree, which carries a maximum penalty of 30 years in prison and a $40,000 fine.

Schulz also faces a charge of criminal sexual conduct in the second degree, which carries a maximum penalty of 25 years in prison and a $35,000 fine.

According to the complaint:

On Nov. 10, a Fairmont police officer received a phone call from a woman who said she was looking at the Martin County jail roster website when her daughter’s friend, a juvenile male, observed a photo of Schulz. The boy said Schulz had “touched him” about five years ago.

The officer spoke with the juvenile, who explained that the event took place at Schulz’s apartment in Fairmont. The apartment was later determined to be located in the 600 block of Burton Lane.

The juvenile explained that Schulz was a friend of his mother, and that she would take him to Schulz when she had to work. The officer determined the boy would have been 10 years old at the time of the event.

The boy said Schulz would pin him down, remove articles of clothing and sexually assault him.

On Nov. 10, the officer spoke with the juvenile’s mother. She denied she had Schulz babysit five years ago, because she was not working. She said she would take her son to Schulz’s apartment because a younger relative of Schulz was his friend.

On Dec. 2, the officer spoke with a female relative of Schulz. She said the juvenile in question would visit about once per month and would torture cats with another child, so he was no longer allowed in the apartment. She denied that Schulz was alone with the boy, but did say he would play video games in Schulz’s room with another child.

The officer later spoke to the other child, who indicated that sometimes he was there when Schulz watched the juvenile and sometimes he was not. The child said Schulz’s older female relative would sit in her chair and do nothing but watch TV. He said that on one occasion he observed Schulz touch the juvenile. He explained he walked in on Schulz and the other child when they were both under the covers and he observed movement. Later in the conversation, the child remembered he observed this behavior two times.
