Kaiden N. Boerner, 20, of Fairmont received a statutory stay of adjudication on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, five years supervised probation, sentence to service seven days for indeterminate, contact probation officer as directed, complete comprehensive assessment and follow all recommendations of care and aftercare if recommended by probation agent, complete diagnostic assessment as directed by probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, cognitive skill training as directed by probation agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of possess over 1.4 grams of marijuana in motor vehicle, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.

Broderick R. Cook, 39, of Sherburn was convicted on a felony charge of obstruct legal process-interfere with peace officer; fined $3,708.60, restitution $3,323.60, commit to Commissioner of Corrections 15 months, stayed five years, sentenced to jail 90 days, credit for time served eight days, work release is granted if eligible, five years supervised probation, contact probation officer as directed, pay restitution, complete comprehensive assessment and follow all recommendations, complete gambling assessment and follow all recommendations, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also received a stay of adjudication on a felony charge of domestic assault by strangulation; fined $1,100, sentenced to jail 30 days, jail time is to be broken up in three-day increments, STS is granted if eligible, three years supervised probation, contact probation officer as directed, complete domestic abuse natterer’s intervention program and follow all recommendations from the program, no contact with victim(s) although defendant may have contact (phone or text) with victim for the next 30 days and if court receives info that victim is comfortable with in-person contact then the court will review request and possibly amend the condition, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of second-degree assault with a dangerous weapon, and misdemeanor charges of domestic abuse-violates Order for Protection within 10 years of previous conviction, fourth-degree damage to property-intentional damage-other circumstances, domestic assault-intentionally attempts to inflict bodily harm on another, and interrupt/interfere/impede/disrupt emergency telephone calls or communications, were all dismissed.

Travis R. Gonzales, 38, of Oil City, Pa. was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, commit to Commissioner of Corrections 17 months, stayed five years, sentenced to jail 81 days, credit for time served 81 days, work release is granted if eligible, five years unsupervised probation. Additional felony charge of third-degree controlled substance possession-10 grams or more of a narcotic drug was dismissed.
