Carlos Sifuentes Moreno, 64, of Fairmont, was convicted of traffic-dl-driving after cancellation-inimical to public safety; fined $560, sentenced to jail 364 days, stay 362 days for two years, credit for time served two days, unsupervised probation two years, no same or similar offenses.

Terry L. Thimesch, 68, of Fairmont, was convicted of traffic-third degree driving while impaired-operate motor vehicle-alcohol concentration 0.08 within two hours; fined $810, sentenced to jail 364 days, stay 364 days for two years, unsupervised probation two years, no same or similar, complete comprehensive assessment, complete and pay for comprehensive assessment within 60 days of sentencing and follow recommendations in a timely manner, defendant must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family and household members and recent treatment providers as part of their assessment, defendant must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, attend MADD Impact Panel, no alcohol or controlled substance use with the exception of prescribed medications, no possession of alcohol or drugs with the exception of prescribed medications, random testing if requested by law enforcement. Benjamin J. Novack, 26, of Welcome, was convicted of damage to property-fourth degree-intentional damage-other circumstances; fined $85, sentenced to jail 30 days, stay 30 days for one year, unsupervised probation one year, no same or similar, pay restitution if ordered, restitution is reserved for 30 days, due within eight months and is joint and several with 46-CR-26-470, write letter of apology to owner of building, send to the victim and the County Attorney’s office to ensure completion, do not enter additional locations, property where offense occurred. Received an additional charge of theft-take/use/transfer movable prop-no consent; dismissed.
