Brett A. Smitherman, 38, of was convicted on a felony charge of fleeing a peace officer in a motor vehicle; fined $1,085, commit to Commissioner of Corrections 15 months, stayed three years, sentenced to jail 22 days, credit for time served 22 days, three years supervised probation, contact probation officer as directed, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, maintain employment, take medications in prescribed dosage and frequency, follow all conditions set forth in the probation agreement, cognitive skill training if recommended by agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. An additional felony charge of counterfeiting of currency-uttering or possessing, and misdemeanor charges of fifth-degree controlled substance possession-not small amount of marijuana, and possess ammo or any firearm-user of controlled substance, were all dismissed.
