Michael R. Nielsen, 38, of Blue Earth was convicted of third-degree driving while impaired-refuse to submit to chemical test fined $610, sentenced to jail 365 days, stayed 362 days for two years, credit for time served three days, two years supervised probation, contact probation officer as directed, complete chemical assessment and follow all recommendations, no mood-altering chemicals, random testing, attend MADD impact panel, obtain drivers license, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed. Also received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; sentenced to jail three days, credit for time served three days, one year supervised probation, contact probation officer as directed, complete chemical assessment within 30 days and follow all recommendations, no mood-altering chemicals, random testing, attend MADD impact panel, take medications in the prescribed dosage and frequency, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charges of driving without a valid license for vehicle class or type, failure of driver to carry proof of insurance when operating a vehicle, and driving wrong way on one-way street, were all dismissed.

Brandon D. Aukes, 40, of Blue Earth was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $385, sentenced to jail 30 days, credit for time served seven days, serve remaining jail time on EHM at defendant’s expense, three years supervised probation, sentence to service 40 hours for indeterminate, contact probation officer as directed, follow all recommendations of chemical use assessment including treatment and aftercare, obtain permission from agent before leaving the state, no mood-altering chemicals, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, take medications in the prescribed dosage and frequency, participate in counseling until discharged from provider, cognitive skill training as assigned by agent, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, do not register to vote or vote until discharged from, probation and civil rights are fully restored. Also convicted of third-degree driving while impaired-one aggravating factor; sentenced to jail 30 days, credit for time served seven days, serve remaining jail time on EHM at defendant’s expense.
