Thai A. Risk, 21, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of check forgery-offer or possess with intent to defraud; fined $1,185, sentenced to jail 83 days, credit for time served 83 days, five years supervised probation, contact probation officer as directed, obtain permission from agent before leaving the state, pay restitution if filed within 30 days, complete a chemical dependency assessment within 60 days of sentencing and follow all recommendations for care and aftercare, complete the South Oaks Gambling screen and follow all recommendations for further programming as directed by supervising agent, any out-of-pocket expenses for treatment or assessments can be credited from fine amount, provide list of prescribed medications to probation officer, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional charges of disorderly conduct-offensive/abusive/noisy/obscene, check forgery-offer or possess with intent to defraud, tamper with motor vehicle-enter without owner permission, and theft-take/use/transfer movable property without consent, were all dismissed.
Michael D. Marsh, 53, of Truman was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $935, sentenced to jail 365 days, stayed 335 days for two years, credit for time served five days, remaining jail sentence shall be served on EHM with alco-sensor, work release is granted, two years supervised probation, contact probation officer as directed, complete chemical assessment and follow all recommendations of evaluation, obtain permission from agent before leaving the state, attend MADD impact panel, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no same or similar, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charges of operate motor vehicle while under the influence of alcohol, and driving after cancellation-inimical to public safety, were both dismissed.
Dayton L. Nielsen, 23, of Fairmont was convicted on a felony charge of first-degree controlled substance sales-17 grams or more within a 90-day period; fined $420, restitution $420, commit to Commissioner of Corrections 73 months, give a DNA sample when directed, pay restitution. Additional felony charge of third-degree controlled substance possession-10 grams or more was dismissed.
Benjamin R. Spitzer, 42, of Fairmont was convicted of driving while impaired-refuse to submit to chemical test-breath or test refusal; fined $910, sentenced to jail 365 days, stayed 275 days for two years, credit for time served six days, 60 days shall be served on EHM with alco-sensor with the remaining jail sentence to be served after the EHM in jail, two years supervised probation, contact probation officer as directed, complete diagnostic/psychological assessment and follow all recommendations of assessment, obtain permission from agent before leaving the state, attend MADD impact panel, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain employment, obtain health insurance, contact Human Services if needing assistance, complete Driving with Care program, complete chemical assessment, remain law-abiding, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charge of operate motor vehicle while under the influence of alcohol was dismissed.
