Woman faces burglary charges

FAIRMONT — A Fairmont woman is facing felony charges in Martin County. Ashley Marie Mosley, 36, has been charged with two counts of burglary in the first degree. Each charge carries a maximum penalty of 20 years in prison and a $35,000 fine.

According to the complaint:

At approximately 7:52 a.m. on June 22, 2021, Fairmont Police Officers were called to the residence of a male individual in the 500 block of North Hampton Street on a report of a disturbance. Upon arrival officers observed Mosley standing in the entryway and observed the male at the front door.

An officer spoke with the man, who indicated that Mosley had broken into his residence through a window that leads to the basement. He showed the officer the broken window and stated that Mosley began “freaking out” and breaking things in the house. He also indicated that she grabbed and scratched him.

The officer observed fresh scratched over the man’s torso and a bite mark in the area of his lower left shoulder blade. The man indicated that he left and a relative stayed to assist Mosley in moving things out of the residence.

The man showed the officer a video that showed Mosley obtain a lawn chair and place it on the south side of the home. The video appears to show Mosley grab something from the ground and climbing on top of the chair. The man was then heard yelling from inside the home.

Mosley then puts her shoulder into the door and tells the man to let her in. Minutes later Mosley bangs on the back door and continues to tell the man to let her in.

Mosley then abruptly walks to the basement window and kicks it. She then appears to rip something away and hit the window located above. She then begins hitting the basement window, and the man is heard telling Mosley he is calling the police.

The man also showed other videos alleged to be from the incident. In one of the videos, Mosley is seen aggressively holding onto the man while he tells her she needs to leave the residence.

An officer spoke with Mosley, who advised that she arrived at the residence at approximately 5 a.m. She indicated that she thought the man had stolen her phone so she attacked him and “clawed his throat.”

A review of Mosley’s criminal history shows a conviction for a qualified domestic violence-related offense in 2015.
