Melanie L. Augst, 40, of St. James received a stay of imposition pursuant to Minnesota statutes on a felony charge of theft-take/use/transfer movable property without conviction; fined $390.38, restitution $390.38, five years supervised probation, contact probation officer as directed, pay restitution within the first year of probation, write letter of apology as directed by supervising agent, complete comprehensive assessment within 90 days of sentencing and follow all recommendations for care and aftercare, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, provide list of prescribed medications to probation officer, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored.
James J. Bray, III, 18, of Fairmont was convicted of trespass-return to property within one year; fined $285, sentenced to jail 10 days, stayed 10 days for six months, six months unsupervised probation, remain law-abiding, don’t enter Walmart store in Fairmont, no same or similar.
Hunter J. Cox, 24, of Fairmont was convicted of harassment-cause or reasonably expect to cause substantial emotional distress to other person; fined $424.95, restitution $324.95, sentenced to jail 365 days, stayed 305 days for two years, jail time to be served in five 12-day increments beginning 1/3/2023 until jail is satisfied, work release and STS are granted if eligible, two years supervised probation, contact probation officer as directed, pay restitution within six months, complete comprehensive assessment and follow recommendations of evaluation, no direct or indirect contact with victim(s), don’t enter victim’s residence or property, follow recommendations of most recent neuropsychological evaluation, cooperate with any referrals from probation agent as directed, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, remain law-abiding, no assaultive or disorderly behaviors, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Two additional felony charges of first-degree attempt to commit arson in dwelling, and terroristic threats-reckless disregard risk, and misdemeanor charges of offensive/abusive/boisterous/noisy/obscene, public nuisance-annoy/injure/endanger safety, and unlawful deposit of garbage, litter or like, were all dismissed.
Grant P. Goraczkowski, 40, of Fairmont was convicted on a felony charge of theft-take/use/transfer movable property without consent; fined $1,491.92, restitution $1,391.92, commit to Commissioner of Corrections 366 days, sentenced to jail 58 days, credit for time served 58 days, five years supervised probation, sentence to service 10 days for indeterminate, contact probation officer as directed, make minimum restitution payments of $50 per month, no contact with victim(s), complete the South Oaks gambling screen and follow any recommendations, complete a cognitive thinking program as directed by supervising agent, mental health diagnostic assessment within 90 days of sentencing and follow recommendations, pay for and complete comprehensive assessment within 60 days of sentencing and follow all recommendations, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, provide supervising agent proof of THC prescription, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Two additional felony charges of theft-take/use/transfer movable property without consent and solicit/conspire juvenile to commit crime, and a misdemeanor charge of solicit/conspire juvenile to commit crime, were all dismissed.
