Zakary C. Hill, 30, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,185, commit to Commissioner of Corrections 15 months, stayed five years, sentenced to jail 30 days, credit for time served 30 days, five years supervised probation, contact probation officer as directed, cognitive skill training as directed by agent, complete chemical dependency assessment and abide by all recommendations for care and aftercare including Halfway House or other extended placement, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, work with vocational rehabilitation as directed by agent, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional charge of possession of drug paraphernalia-use or possession prohibited was dismissed.

Kevin A. Hoiland, 28, of Fairmont was convicted on a felony charge of third-degree controlled substance sale-conspiracy to commit drugs; fined $100, commit to Commissioner of Corrections 21 months, stayed five years, sentenced to jail 180 days, credit for time served 98 days, five years supervised probation, contact probation officer as directed, cognitive skill training as directed by supervising agent, complete chemical assessment within 60 days of sentencing and follow all requirements for care and aftercare, provide list of prescribed medications to probation officer, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Myhre, 34, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $125, commit to Commissioner of Corrections 366 days, stayed five years, sentenced to jail 45 days, credit for time served two days, work release is granted if eligible, five years supervised probation, contact probation officer as directed, cognitive skill training as directed by supervising agent, complete chemical assessment within 60 days of sentencing and follow all recommendations for care and aftercare, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, complete diagnostic assessment within 90 days of sentencing and follow all recommendations for care and aftercare, provide list of prescribed medications to probation officer, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional felony charge of third-degree controlled substance possession-in school/park/public housing zone, and misdemeanor charges of pharmacy-unlawfully possess/sell/barter/exchange/distribute legend drugs, and possession of drug paraphernalia-use or possession prohibited, were all dismissed.
