Willy J. Schmidt, 47, of Worthington received a stay of imposition pursuant to Minnesota statutes on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,160, sentenced to jail 49 days, credit for time served 49 days, three years supervised probation, contact probation officer as directed, successfully complete outpatient program at New Life as well as Project Morning Star sober house and follow all aftercare recommendations, no mood-altering chemicals, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted of domestic assault-subsequent violation; fined $910, sentenced to jail 365 days, stayed 316 days for two years, credit for time served 49 days, two years supervised probation, contact probation officer as directed, complete domestic abuse batterer’s intervention program as required by Minnesota statutes, don’t reside with victim until enrolled in domestic abuse program, successfully complete outpatient program at New Life as well as Project Morning Star sober house, no mood-altering chemicals, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of second-degree assault with a dangerous weapon, and a misdemeanor charge of domestic abuse-violate No Contact Order within 10 years of previous conviction, were both dismissed.
