Danilo A. Throne, 25, of Fairmont was convicted of fifth-degree assault-within three years of previous conviction; fined $75, sentenced to jail 365 days, stayed 305 days for two years, credit for time served 32 days, two years supervised probation, sentence to service seven days for indeterminate, contact probation officer as directed, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, complete updated chemical dependency assessment if recommended by agent, pay restitution if filed within 60 days, no contact with victim(s), may retrieve personal belongings from property with law enforcement assistance, no assaultive, disorderly or threatening behavior, obtain permission from agent before leaving the state, cognitive skill training as directed by agent, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of third-degree assault-substantial bodily harm was dismissed.
Anthony A. Baumgart, 41, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, attend MADD impact panel, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no same or similar. Additional charges of fourth-degree driving while impaired, and operate motor vehicle while under the influence of alcohol, were both dismissed.
Brandon J. Carlson, 35, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $910, sentenced to jail 365 days, stayed 335 days for two years, credit for time served three days, two years supervised probation, work release granted if eligible, can serve remaining 27 days on EHM with alco-sensor, contact probation officer as directed, no same or similar, attend MADD impact panel, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charges of driving after revocation, uninsured vehicle-driver violation, and operate motor vehicle while under the influence of alcohol, were all dismissed.
Ayraldo A. Sanchez Contreras, 29, of Fairmont was convicted of failure to stop at stop signs or stop lines at entrance to thru highway; fined $135. Also convicted of driving wrong way on a one-way street; fined $100.
Avory J. Vleiger, 20, of Fairmont was convicted of driving after revocation; sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, sentence to service five days for indeterminate, no same or similar.
