Diekmann, 31, of Fairmont was convicted of fourth-degree burglary; fined $75, sentenced to jail 365 days, stayed 305 days for two years, credit for time served 18 days, defendant can be furloughed directly to inpatient treatment when a bed is available, two years supervised probation, contact probation officer as directed, complete chemical assessment, follow recommendations of evaluation, obtain permission from agent before leaving the state, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, enter into and successfully complete inpatient treatment and follow all recommendations for care and aftercare, pay restitution if filed within 30 days, cognitive skill training as directed by probation agent, don’t enter victim’s residence where burglary occurred, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charge of fourth-degree damage to property-intentional damage-other circumstances was dismissed.

Oscar A. Rodriguez, 44, of St. James was convicted of speeding; fined $125. Also convicted of no Minnesota drivers license; fined $100.
Samuel A. Garcia, 19, of St. James received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $600, sentenced to jail one day, credit for time served one day, one year supervised probation, contact probation officer as directed, complete chemical assessment, follow all recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, remain law-abiding, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives is prohibited by law. Additional felony charge of fifth-degree controlled substance possession-not small amount of marijuana was dismissed.
