Mark P. Hayes, 54, of Fairmont received a stay of adjudication on a charge of malicious punishment of a child-less than substantial bodily harm; fined $300, sentenced to jail two days, credit for time served two days, two years supervised probation, contact probation officer as directed, obtain permission from agent before leaving the state, complete chemical assessment if recommended by probation agent or Human Services, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession, random testing, follow all aspects of CHIPS case plan and/or out of home placement plan, contact with children to be followed by recommendations from Human Services, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of malicious punishment of a child-less than substantial bodily harm, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.

Chad T. Woods, 32, of Fairmont had a charge of failure of driver to carry proof of insurance when operating a vehicle continued for dismissal; fined $285, six months unsupervised monitoring without conviction, maintain valid motor vehicle insurance.

Lewis Brewster, 49, of Rochester was convicted of driving after revocation; fined $200, sentenced to jail three days, credit for time served three days. Additional charges of operate vehicle with expired registration, and failure of driver to carry proof of insurance when operating a vehicle, were both dismissed.

Amber L. Engebretson, 44, of Fairmont received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $685, sentenced to jail five days, credit for time served five days, one year supervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession, random testing, remain law-abiding. A felony charge of fifth-degree controlled substance possession-not small amount of marijuana was dismissed.

Gabriel Fragoso, 48, of Estherville, Iowa was convicted of wireless communications device-initiate/compose/send/retrieve/read electronic message; fined $135. Additional charge of failure of driver to carry proof of insurance when operating a vehicle was dismissed.
