Michael A. Porter, 30, of Blue Earth was convicted of fifth-degree assault; fined $185, sentenced to jail 365 days, stayed 305 days for two years, credit for time served three days, serve 30 straight days in jail if unemployed and if employed can do three-day weekends, serve remaining 30 days on EHM with alco-sensor, two years supervised probation, complete a diagnostic psychological assessment and follow all recommendations, complete current domestic violence program and follow all recommendations, successfully complete current outpatient chemical dependency treatment and follow all recommendations for care and aftercare, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, remain law-abiding. Also convicted of fifth-degree criminal sex conduct-nonconsensual sex contact; fined $100, sentenced to jail 365 days, stayed 305 days for two years, credit for time served three days, concurrent with other case, two years supervised probation, complete a diagnostic psychological assessment and follow all recommendations, complete current domestic violence program and follow all recommendations, successfully complete current outpatient chemical dependency treatment and follow all recommendations for care and aftercare, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, remain law-abiding, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of fifth-degree assault-two or more previous convictions in three years was dismissed.
Michelle L. Rasche, 41, of Fairmont received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $575, sentenced to jail two days, credit for time served two days, one year supervised probation, contact probation officer as directed, obtain permission from agent before leaving the state, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charge of possession of drug paraphernalia-use or possession prohibited, was dismissed.
Andy L. Larsen, 37, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, no same or similar. Additional charges of fourth-degree driving while impaired, and operate motor vehicle while under the influence of alcohol, were both dismissed.
Andrew S. Oldenburg, 31, of Fairmont was convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, no same or similar, restitution reserved.
Julie K. Fleming, 25, of Fairmont was convicted of wireless communications device-initiate/compose/send/retrieve/read electronic message; fined $135. Also convicted of vehicle registration/permit/plates required; fined $30.
