Man charged with threats, assault

FAIRMONT — A Fairmont man is facing felony charges in Martin County. Roy William Helton, 33, has been charged with one count of making terroristic threats, which carries a maximum penalty of five years in prison and a $10,000 fine. Helton is also charged with assault in the fourth degree, which carries a maximum penalty of three years in prison and a $6,000 fine.

According to the complaint:

At approximately 10:51 p.m. on August 28, 2021, a deputy with the Martin County Sheriff’s office was on duty when deputies were dispatched to the Granada Bar and Grill in Granada, following a report of a male that was highly intoxicated and throwing things around the bar. Dispatch said that the suspect was preparing to leave in a black Cadillac. As the deputy was responding to the scene, dispatch informed him that the suspect had left in his vehicle and had now collided with a grain bin.

Upon arrival, the deputy was met by a bar employee who directed him to the railroad tracks, where the deputy observed a black Cadillac on the tracks. The employee explained that the male driving the car had a shaved head, tattoos, and had fled on foot to the northwest after causing the accident on the railroad tracks. The employee told the deputy that he only knew the male as “Roy.”

The deputy started checking the area and observed a white Chevy Suburban with Iowa plates on the side of the road. Shining his alley light into the vehicle, the deputy observed a male, later identified as Helton, in the front passenger seat.

The deputy approached Helton, who was then placed in handcuffs. The deputy informed Helton that he was not under arrest, but was being detained. Helton immediately started yelling and refusing to comply with any orders.

A second deputy arrived and the pair had to hold Helton against a squad car as he was trying to pull away. Helton told the deputies he was going to head-butt and spit on them. The bar employee arrived and identified Helton as the male that had been causing problems and left in the Cadillac.

Once inside the squad car, Helton attempted to kick out the door window. As the deputy drove to the jail, Helton continued to threaten the deputy and made comments about kicking him in the head and raping him.

When the deputy arrived at the Martin County Jail, Helton exited the squad car and immediately acted belligerently. At one point, Helton began smashing his face against the vehicle. Helton continued to pull away from the deputy and a corrections officer and attempted to kick the deputy.

Helton was placed against a wall and continued to try and kick the deputy. Officers held Helton on the ground in the security garage as additional officers responded. While on the ground Helton continued to threaten the officers by saying he was going to rape them, head-butt them, and spit on them.

A corrections officer placed a spit hood over Helton as other officers assisted with placing Helton into the restraint chair. While officers were placing Helton in the chair, he continued to actively resist.

Helton head-butted an officer leaving a red mark on the left side of his face, and attempted to spit at the officers through the spit hood. At one point an officer felt Helton’s spit particles hit him in the eyes.

Helton was placed in the booking room, where the deputy read him the Minnesota Breath Test Advisory. When asked if he understood, Helton cussed at the deputy. Helton has prior incidents from January 2016 and February 2016.
