Man faces multiple charges

FAIRMONT — A Garner, Iowa, man is facing multiple felony charges in Martin County. John Allen Ausborn, 59, has been charged with four counts of criminal sexual conduct in the first degree. Each charge carries a maximum penalty of 30 years in prison and a $40,000 fine. Ausborn also faces four charges of criminal sexual conduct in the third degree, with each charge carrying a maximum penalty of 15 years in prison and a $30,000 fine.

According to the complaint:

In October of 2020, the Fairmont Police Department began an investigation into alleged sexual contact between a 15-year-old female and Ausborn. During an October 7, 2020 interview with a Fairmont Police officer, the girl admitted to sexual intercourse with Ausborn on two occasions. She indicated these incidents occurred in his semi-truck at truck stops.

She stated she did not know in what state the acts occurred. Another officer had previously observed text messages between Ausborn and the girl which appeared to suggest an inappropriate sexual relationship.

On March 1, 2012, an officer was contacted by the supervisor of the Child Protection Unit of Human Services of Faribault and Martin Counties. The supervisor advised that the girl had disclosed to two adults that Ausborn had sexually assaulted her, beginning when she was five years of age.

On March 4, 2021, an officer met with the girl at the Martin County Law Enforcement Center. During the interview, the girl explained that Ausborn lived on the same street as her family did when she was younger. She indicated that on occasion she went over to Ausborn’s house and that she was five years old at the time. The officer later determined that the girl and Ausborn had lived on the same street in Fairmont at the time described.

The girl indicated that when she went over there a few times, Ausborn touched her inappropriately and forced himself on her. She stated that she struggled to get away but could not. When asked how many times this happened, she indicated it had happened every time she was alone with Ausborn, indicating it had gone on for five years.

The girl advised that Ausborn told her not to tell anyone. He indicated if she did, he would make it look like the blame was on her. The girl went on to describe multiple incidents.

When asked if she ever drove with Ausborn in his semi-truck she advised that she did, but only in the year 2020. She advised that a relative had discovered Ausborn on Facebook and contacted him.

She explained that once or twice she went with Ausborn in his semi-truck in the evening. She explained that they went to his workplace in Truman, where Ausborn forcefully sexually assaulted her. She stated this happened in the spring of 2020 and in the summer of 2020.
