Fairmont man faces felony charges

FAIRMONT — A Fairmont man is facing multiple felony charges in Martin County.

Damion Blake Hiebert, 24, has been charged with four counts of assault with a dangerous weapon in the second degree. Each charge carries a maximum penalty of seven years in prison and a $10,000 fine.

Hiebert also is charged with two counts of making threats of violence, each of which carries a maximum penalty of five years in prison and a $10,000 fine.

He also faces an additional charge for threats of violence, which carries a maximum penalty of one year and one day in prison and a $3,000 fine.

According to the complaint:

At 4:33 p.m. July 26, a Fairmont police officer responded to a report of theft. The officer met with the complainant along Downtown Plaza, and recognized the complainant as Hiebert.

Hiebert said he was at the shelter house at Ward Park playing video games with his friend. He said he went to use the restroom and, upon returning, was advised that a juvenile had taken some AAA batteries from his backpack. Hiebert said the juvenile had thrown the batteries in the lake. The officer determined the theft loss to be less than $1.

At 5:10 p.m., Martin County dispatch advised that a caller was on the phone asking to speak to an officer about Hiebert. The officer spoke with the caller, who said she had just picked up her child and boyfriend from Ward Park. She said they told her Hiebert had pointed a BB gun and a knife at juveniles in the shelter house.

The officer drove to Gomsrud Park where the woman, child and boyfriend were located. The boyfriend said they were at Ward Park around 2 p.m. and Hiebert arrived around 3 p.m., then later returned with a PS3 game console and a television. The boyfriend said Hiebert and others were playing games on the console during this time.

The boyfriend advised that at one point a number of 13- or 14-year-old children were “messing” with Hiebert by hiding his controller. The man said Hiebert then pulled a black pistol-style BB gun. The man said he told Hiebert to put the gun away or he would put hands on him to protect everyone else.

The witness also told the officer that Hiebert pulled a knife, saying “Give me the batteries or I will stab you.”

The officer traveled to Ward Park and located the 13-year-old boy whom Hiebert had threatened and accused. The boy said that when Hiebert went to the bathroom he hid Hiebert’s controller, and that when Hiebert returned, Hiebert pulled a knife and gun on them.

After speaking with others who were present, the officer went to Hiebert’s residence and Hiebert was placed under arrest. He was searched and a folding knife was found in his pocket, matching the description given. A loaded BB gun was found in Hiebert’s backpack.
