Fairmont men charged with drug crimes

FAIRMONT — Two Fairmont men are facing felony charges in Martin County.

Joshua Dewaine Scholl, 31, and Daniel Eric Conn, 31, have each been charged with one count of drug possession in the third degree, which carries a maximum penalty of 20 years in prison and a $250,000 fine.

According to the complaint:

On Oct. 22, Fairmont police officers were called to a residence in the 200 block of East 11th Street on a report of someone trying to break into a garage. Officers arrived on scene and were advised by the resident that the break-in was actually across the street.

Officers responded and observed a male, later identified as Conn, in the garage. Officers placed Conn in handcuffs.

As officers were clearing the garage for other suspects, they observed a marijuana pipe and clear baggie containing white residue.

Conn was advised of his rights and agreed to speak with an officer.

Conn said he had pried the garage door open to gain access because his friend, Scholl, told him that he could go in to get his belongings because he had been staying there the past few days. When asked about the meth baggie, Conn said he knew about a meth pipe, but not a bag.

During this time, the residence’s occupant, Scholl, exited the residence and spoke with officers. Scholl said he lives at the house and sent Conn outside to get the keys out of the garage.

Dispatch advised that Scholl had an active warrant out for his arrest and he was placed under arrest.

Police obtained and executed a search warrant for the garage. Officers discovered two meth pipes, a homemade pipe made out of a bottle, a clear shot glass containing white reside, a homemade bong, nine plastic baggies containing white residue, a digital scale and other drug paraphernalia. A number of the baggies found tested positive for meth.

Other items were discovered in a bedroom inside the home.

Scholl was interviewed at the Martin County jail, where he was advised of his rights. Scholl admitted one of the “dope pipes” in the garage belonged to him. He also admitted it was used for smoking meth.

Scholl said he had last smoked meth in the garage three days prior.

The residence in question is within once city block of the Fairmont alterative learning center school.
