Predator facing 2 felony charges

FAIRMONT — A homeless man is facing felony charges in Martin County.

Oscar Ramiro Arellano, 44, has been charged with two counts of being a predatory offender and knowingly violating registration requirements. Each charge carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

On July 24, Fairmont police received a report that Arellano was sleeping in a garage in the 400 block of East 10th Street.

Arellano is required to register under the Minnesota Predatory Offender Act.

An officer spoke with Arellano, who indicated he had been staying at the residence for three nights because he is homeless and the owner said it was OK. The officer later spoke with the homeowner, who said he was not OK with Arellano staying there, and wanted him to leave.

On July 25, the officer again made contact with Arellano, this time at Kwik Trip in Fairmont. During the interaction, Arellano was paranoid and hallucinating. He indicated he wanted to go to detox, and ultimately provided a test showing he was positive for marijuana and meth.

On Aug. 28, another officer reviewed Arellano’s predatory offender registration. It indicated that on June 29 Arellano had registered his primary address in the 600 block of Burton Lane. The officer became suspicious that Arellano had not complied with his requirements as he had indicated he was homeless. Under the Predatory Offender Act, individuals who leave a primary address and do not have a new primary address are required to register where they are staying within 24 hours of losing their primary address. The individual is then required to report in-person on a weekly basis.

The officer spoke to an individual who lives at the apartment where Arellano is registered. The individual indicated that Arellano did not live at the apartment and has only stayed there a couple of nights. He also said he had not seen Arellano for a week.

On Aug. 12, the officer spoke with Arellano about his registration. Arellano indicated he had just returned from Iowa, where he said he was not registered because he was not going to live there. He said he did not know the address of the location in Iowa where he was staying.

On Aug. 13, the officer again spoke with Arellano, who admitted he had not been staying at the address on Burton Lane since he moved from a prior residence in Winnebago. Arellano said he was now going to live with the individual on Burton Lane.
