Woman faces felony drug count

FAIRMONT — A Fairmont woman is facing a felony charge in Martin County.

Rachel Ann Spencer, 38, has been charged with drug possession in the fifth degree, which carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

On July 22, a Fairmont police officer was dispatched to the 200 block of Cedarwood Street on a report of a suspicious person. Dispatch advised that the caller had come home from work and noticed a male yelling in the street. Another officer arrived on scene and spoke to the caller.

The officer arrived in the area and observed an individual riding a bicycle that was turning onto Cedarwood Street. The officer observed the bicycle had no rear reflector or front light, which is required at night.

The officer stopped the bicycle and identified the rider as Spencer, whom he knew from previous drug investigations at her residence.

As the officer was getting Spencer’s identification information, he observed her keep reaching into her left pocket. The second officer arrived and stood by Spencer.

The first officer asked Spencer if she had any weapons on her and she said she did not, but she reached for her right pocket. The officer grabbed her hand and told her not to reach into her pockets. Spencer then said she had a knife.

Spencer was ordered to place her hands on her head, and the officer removed the knife. As the officer patted her down, he discovered a bag of meth. After she was patted down, Spencer began to pull away and argue with police.

The officer attempted to place Spencer in handcuffs, which required the aid of the second officer. More meth was located on Spencer, as well as a broken meth pipe, four test tube meth pipes, multiple bags with meth residue and a digital scale.
