Fairmont man faces felony counts

FAIRMONT — A Fairmont man is facing felony charges in Martin County.

Justin Phillip Crowe, 31, has been charged with two counts of domestic assault, each of which carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint, on June 23, Fairmont police officers were dispatched to the Casey’s General Store in Fairmont on a report of a domestic assault. Officers observed a man and a woman at that location, and the man was identified as Crowe. An officer made contact with Crowe, who was verbally aggressive.

Another officer spoke with the woman, who was crying hysterically and said she had been assaulted by Crowe. The woman said they were walking from the bar when Crowe threw her to the ground and punched her on the left side of her jaw. The woman later clarified that Crowe had pressed on her jaw rather than punching it.

She said Crowe proceeded to place one leg on her jaw and neck area, restricting her breathing, and the other knee on her stomach. The woman said she is five months pregnant and Crowe is aware of that fact. Officers later documented redness on the woman’s neck and left side of her face.

Later, at the hospital, the officer obtained a more formal statement from the woman, who indicated she and Crowe had been arguing earlier in the day when Crowe slapped her when she laughed at something she had seen on Facebook. Crowe later left the residence and she determined he had gone to a bar. She proceeded to go to the bar, where she found Crowe.

The woman said she grabbed Crowe by the shirt and began walking him out the door. She said they walked to an alley and she removed his cell phone from his pocket in an effort to get him to come home.

She said Crowe later came up behind her and grabbed her arms, twisting them, and demanded his phone. She said he held her for a short time and then threw her to the ground, where he pinned her. She said he eventually got off her and she gave him his phone.

Crowe was later interviewed and denied assaulting the woman. He admitted she came to the bar and dragged him out.

A check on Crowe’s criminal history shows three or more qualified domestic violence-related convictions within the past 10 years.
