Man facing felony drug count

FAIRMONT — A Lewisville man is facing a felony charge in Martin County.

Brenden Cary Weihe, 18, has been charged with drug possession in the fifth degree, which carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

On Feb. 10, a Martin County Sheriff’s deputy was on patrol, traveling north on Highway 15 through Truman when he observed a vehicle in front of him with a broken driver’s side tail light. The vehicle turned into the Casey’s General Store lot and drove up to a gas pump.

When the vehicle exited the gas station lot, the deputy initiated a traffic stop.

The deputy approached the vehicle and spoke with the driver. While speaking, the deputy observed the odor of fresh marijuana coming from inside the vehicle.

The deputy asked the driver about the odor. The passenger, Weihe, interjected and said he had a small amount of marijuana in his rear pocket. The deputy had the occupants exit the vehicle and removed loose marijuana and a cigar wrapping from Weihe’s pocket. The deputy then conducted a search of the vehicle.

During the search, Weihe indicated there was a marijuana grinder located in his backpack. The deputy searched the backpack and discovered a glass smoking bowl commonly used to smoke marijuana wax. The deputy also discovered a marijuana grinder and a glass pipe, along with a small rubbery container containing a wax substance, which later tested positive for THC.

Weihe was placed under arrest and transported to the Martin County jail. Weihe was interviewed and agreed to answer questions.

During the interview, Weihe admitted he had purchased 1 gram of marijuana wax from an individual in Fairmont earlier that day. He also admitted to smoking marijuana and marijuana wax.
