Local man faces assault charge

FAIRMONT — A Fairmont man is facing a felony charge in Martin County.

Jose Luis Castano, 60, has been charged with domestic assault, which carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

On Dec. 7, Fairmont police officers responded to a disturbance in the 400 block of Lake Park Boulevard in Fairmont. Upon arrival, the officers could hear yelling and screaming coming from inside. One officer was able to see a man and a woman physically struggling with each other.

The officer recognized the man as Castano, and observed him grabbing the woman’s arm while she attempted to pull away. The officer made an attempt to open the door and enter the residence but the door was locked. The woman opened the door and appeared to have a swollen nose and was bleeding from a swollen mouth.

Both Castano and the woman appeared to be intoxicated and continued to yell at each other while officers attempted to calm them down. At that time, another individual started yelling at Castano from a bedroom. Officers were able to separate the parties.

An officer interviewed the woman, who said Castano had been invited to the home to spend the night. The woman was in a bedroom while Castano was in the living room with the other individual. Castano and the individual got into an argument that evolved into a fight between Castano and the woman.

During the argument, Castano was repeatedly told to leave the bedroom but refused. The other individual once again got involved in the argument. Castano was once again asked to leave, and Castano responded by punching the woman in the face.

The argument moved back into the living room where the woman began telling Castano to leave the house. Castano again refused and the argument became physical once more.

Another officer interviewed the third individual, who said Castano became upset and hit the woman in the face. The individual said Castano was out of control and needed to leave.

Castano was interviewed at the scene and later at the Law Enforcement Center. During both interviews, Castano denied hitting the woman.

A review of Castano’s criminal history shows convictions in 2011 and 2016 for felony domestic assault, both of which are qualified domestic violence-related offenses.
