Man facing drug charge

FAIRMONT — A Woodbury man is facing a felony charge in Martin County.

Gabriel Cirilo Hernandez, 23, has been charged with drug possession in the fourth degree, which carries a maximum penalty of 15 years in prison and a $100,000 fine.

According to the complaint:

On Oct. 4, a Fairmont police officer was on routine patrol in Fairmont when he observed a vehicle driving north on Albion Avenue with a headlight out and objects suspended from the rearview mirror. The officer proceeded to stop the vehicle and spoke to the driver, later identified as Hernandez. The officer advised Hernandez that he could not have objects hanging from the rearview mirror.

While speaking, the officer could smell a strong odor of marijuana coming from the vehicle. The officer observed a green backpack at the feet of the front seat passenger, a female. There were also miscellaneous items of garbage inside the vehicle.

The officer asked Hernandez to be straight with him and asked if there was anything in the vehicle he should know about. Hernandez said there was a bowl and grinder in the center console.

A Martin County Sheriff’s deputy was asked to assist at the scene.

The officer had Hernandez and the passenger exit the vehicle and proceeded to search the vehicle. During the search, the officer located the marijuana grinder and pipe, as well as a plastic container and a glass jar containing marijuana inside. Hernandez said he would take ownership of the backpack.

Also inside the backpack was another baggie that contained about 20 square, perforated, absorbent papers decorated with a design commonly used for psychedelic drugs such as LSD/acid. The officer showed Hernandez the baggie and Hernandez said, “It’s acid.”

Hernandez was read his rights and agreed to answer questions. He proceeded to say the backpack belonged to him, and again said the strips of paper were “acid.” Hernandez said he was taking 100 percent responsibility for everything found in the car and was then placed under arrest.
