Quartet facing drug charges
FAIRMONT — Four people are facing multiple felony charges in Martin County.
Katie Lynn Helmers, 31; Violet Catherine Buckmeier, 56; Tami Jeanette Vogt, 43; and Brandon Mikael Thomas Kiley, 31, have all been charged with one count of drug possession in the fifth degree, which carries a maximum penalty of five years in prison and a $10,000 fine.
Vogt and Kiley also are charged with drug possession in the second degree, which carries a maximum penalty of 25 years in prison and a $500,000 fine, as well as drug possession in the third degree, which carries a maximum penalty of 20 years in prison and a $250,000 fine.
According to the complaint:
On Aug. 20, a Fairmont police officer initiated a controlled substance investigation involving a cooperating defendant, who is under 18. The defendant admitted to purchasing a half-gram of meth from a residence in the 400 block of East 12th Street in Fairmont. The defendant also was given a meth pipe while at the residence.
Based upon information from the defendant, along with past and present information about drug activity at the residence, the officer applied for and was granted a search warrant. At 3:05 a.m., four officers approached the residence and observed there were lights on inside. One of the officers walked to the front door and could see there were people inside.
The officer could see Vogt sitting in a chair near the door, as well as Kiley. The officer knocked on the door and Kiley answered. The officer announced, “Police department, search warrant” and yelled for all individuals to place their hands in the air.
The officer observed four people, the other two being Helmers and Buckmeier. The officer saw that Kiley had dropped a knife to the ground when putting his hands in the air. Officers then secured the residence and all four individuals were placed in handcuffs.
The officer noticed a meth pipe sitting on an end table near where Buckmeier was seated on the couch, and observed there was a haze in the room with a strong odor of burnt marijuana. Another officer removed a meth pipe from one of Kiley’s pockets, and observed a digital scale, butane torch, multiple unused zip lock baggies, $180 in cash and a broken meth pipe near Kiley. Officers also discovered other drug paraphernalia near Kiley’s chair, as well as paraphernalia in the direct vicinity of Buckmeier and in Helmers’ purse.
Officers searched a bedroom, later identified as belonging to Vogt, and discovered more paraphernalia, meth and marijuana, as well as mail addressed to Vogt at the residence. Multiple syringes were also located. All four individuals were transported to the Martin County Jail.
At the jail, Helmers was read her rights and agreed to answer questions. She explained that she was having marital and depression problems and went to speak with Vogt, who had reached out to her. She said that while she was at the house, she started having low blood sugar and Kiley went and got her a drink that she thought tasted funny.
The officer asked Helmers if she was trying to say that she would test positive for meth because Kiley put something in her drink, and she stated she didn’t know, and denied using meth. She stated the last time she used was in 2014.
The officer observed a fresh puncture mark in her right arm and asked about it. Helmers stated she had blood work done at the hospital.
She also said it was the first time she met Kiley. When asked if anyone else came to the residence to buy anything, Helmers said there were a couple of girls who came over whom she did not know.
She explained she was talking with Vogt in Vogt’s bedroom and heard female voices but did not witness them in the house. She indicated Kiley and Buckmeier were out in the living room.
The officer also interviewed Vogt, who indicated she understood her rights. Vogt said she hooked up with Kiley through a friend, and that Kiley had come to the house to supply her with meth that day. She stated she does not buy from Kiley; he just gives it to her.
The officer asked Vogt if Kiley had given her some that day, and she stated that he had not. When asked if Kiley gave Buckmeier or Helmers some that day, she also stated no. The officer asked if Kiley had supplied meth to some people who had come over, and Vogt stated yes.
Vogt indicated that two people had come over, but would not give their names and indicated that Kiley did not know them. The officer asked if Vogt had connected Kiley with the people, and she stated, “Pretty much.” Vogt said the people bought a small amount, and also admitted there were needles in her room.
The officer later spoke with Buckmeier, who indicated she understood her rights. She indicated she had come home at about 6:45 p.m. and Kiley showed up about the same time. Buckmeier stated they were all hanging out and she, Helmers and Vogt were smoking meth.
Buckmeier admitted to owning some of the meth paraphernalia located near her. When asked if she bought the meth from Kiley, she said she did not, because he had just given it to her for letting him hang out there. She indicated tat she had seen Kiley there before.
Buckmeier indicated there were three people who came over and she believed they bought controlled substances from Kiley. She indicated it took place in Vogt’s bedroom, indicating that both Vogt and Kelly were in the room at that time. Buckmeier indicated Vogt had been living at the residence since the end of April.
