Levi B. Joseph N. Silverthorn, 48, of Fairmont was convicted of theft-take/use/transfer movable property without consent; fined $100, sentenced to jail 364 days, stayed 364 days for two years, two years supervised probation, complete cognitive skill training as directed by probation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives. Additional felony charges of theft-take/use/transfer movable property without consent, check forgery-falsely endorse and financial exploitation of a vulnerable adult-breach of fiduciary obligation, were all dismissed.
Dylan J. Christian, 25, of Truman received a stay of adjudication on a charge of neglect of a child-likely substantial physical harm or emotional health; fined $300, two year unsupervised probation, comply with CPS case/process if any, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no same or similar.
Mark A. Sandberg, 62, of Fairmont was convicted on a felony charge of of driving while impaired-alcohol concentration 0.08 within two hours; fined $1,685, commit to Commissioner of Corrections 36 months, stayed for five years, sentenced to jail 90 days, credit for time served 90 days, sentenced to jail 45 days, this segment of jail may be waived and 45 days of EHM with alco-sensor may be served in lieu of jail, five years supervised probation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, successfully complete current treatment program and follow all aftercare recommendations, don’t operate a motor vehicle until proof of valid license and insurance is provided to supervising agent, comply with ignition interlock program as required and have no violations of the interlock program, complete a mental health assessment and follow all recommendations for care and aftercare, keep in contact with probation, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives. 3 additional charges of driving while impaired-alcohol concentration 0.08 within two hours, and 3 charges of operate motor vehicle while under the influence of alcohol, were all dismissed.
