John T. Fredericksen, 40, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of theft-take/use/transfer movable property without consent; fined $4.792.92, restitution $4,787.92, sentenced to jail 60 days, first 60-day sentence to begin 8/2/24 unless $1,600 in restitution has been paid and if paid then the 60 days is deferred, second 60-day sentence will begin 3/7/25 unless restitution of $3,200 is paid and if paid then the second 60 days is deferred, third 60-day sentence will begin 8/8/25 unless full restitution is paid and if paid then the third 60 days is deferred, three years supervised probation, contact probation officer as directed, write letter of apology to victim and submit to agent for approval, complete a mental health diagnostic assessment and follow all recommendations, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives. Also convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, no same or similar. Additional felony charge of theft-indifferent to owner rights was dismissed.

Roland Ybarra, 40, of Rochester was convicted on a felony charge of fifth-degree controlled substance possession (Schedule 1,2,3,4)-not small amount of marijuana; fined $1,160, commit to Commissioner of Corrections 24 months, give a DNA sample when directed. Also convicted on a separate felony charge of fifth-degree controlled substance possession (Schedule 1,2,3,4)-not small amount of marijuana; commit to Commissioner of Corrections 24 months, concurrent with count 1, give a DNA sample when directed. Also convicted on a separate felony charge of fifth-degree controlled substance possession (Schedule 1,2,3,4)-not small amount of marijuana; commit to Commissioner of Corrections 24 months, concurrent with counts 1 & 2, give a DNA sample when directed. Also convicted of vehicle window restrictions-tint too dark; fined $50. An additional felony charge of fifth-degree controlled substance possession (Schedule 1,2,3,4)-not small amount of marijuana, and a misdemeanor charge of failure of driver to carry proof of insurance when operating a vehicle, were both dismissed.
