Fausch, 26, of Fairmont was convicted of operate motor vehicle-body contains any amount of schedule I/II controlled substance-not marijuana; fined $810, sentenced to jail 364 days, stayed 334 days for two years, serve remaining 30 days as staggered sentence, two years supervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend and complete MADD impact panel and pay the cost, cognitive skill training as deemed appropriate by probation officer, provide list of prescribed medications to probation officer, individual therapy until successfully discharged, don’t leave Minnesota without written court approval, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed.

Joanna Frances M. Magee, 21, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of receiving stolen property; fined $100, sentenced to jail 56 days, credit for time served 56 days, five years supervised probation, sentence to service 80 hours for indeterminate, contact probation officer as directed, pay restitution once affidavit is filed, restitution reserved for 30 days, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing at the request of law enforcement or probation, complete a mental health assessment and follow all recommendations for care and aftercare, complete cognitive skills program such as Thinking for a Change as directed by supervising agent, provide list of prescribed medications to probation officer, provide a valid medical marijuana card and proof of purchase from an approved dispensary, no contact with victim(s), obtain and maintain employment to the best of ability, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition or explosives. Additional felony charge of theft of a motor vehicle was dismissed.
