Ferdy L. Velasquez Diaz, 34, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $810, sentenced to jail 364 days, stayed 334 days for two years, 48 hours to be served in custody and remaining 28 days to be served on EHM with alco-sensor, may have work release while in custody if eligible, two years supervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, don’t enter bars or liquor stores, no misdemeanor or greater violations of the law while on probation, no same or similar, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition or explosives. Additional charge of operate motor vehicle while under the influence of alcohol, was dismissed.

Madasin M. Whitehead, 19, of Sherburn was convicted of driving while impaired-operate motor vehicle while under the influence of cannabis/hemp products or artificial CBD/THC; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, contact Martin County Probation for assistance in setting up, no same or similar. Luis R. Rodriguez Burgos, 29, of Fairmont was convicted of driving after revocation; fined $200. Also convicted of uninsured vehicle-driver violation; fined $200. Also convicted of vehicle window restrictions-tint too dark; fined $50.

Latell J. Chaney, Jr., 22, of Fairmont was convicted of failure of driver to carry proof of insurance when operating a vehicle; fined $200. Also convicted of speeding; fined $145.
