Tomas J. Machado, 31, of Fairmont was convicted of domestic assault-subsequent violation; fined $185, sentenced to jail 364 days, stayed 334 days for two years, credit for time served 30 days, two years supervised probation, sentence to service five days for indeterminate, contact probation officer as directed, follow all recommendations of the comprehensive assessment completed by Martin County Human Services, complete a diagnostic assessment with an approved provider and follow all recommendations, successfully complete domestic violence programming with an approved provider and follow all recommendations, participate in cognitive skills programming as directed by the probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, submit to random testing as directed, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives. Also convicted of domestic abuse-violate No Contact Order within 10 years of previous conviction; fined $85, sentenced to jail 364 days, stayed 324 days for two years, credit for time served 20 days, serve 30 concurrent days in jail before 5/6/24 plus additional 10 days per the plea agreement, work release permitted, two years supervised probation, sentence to service five days for indeterminate, contact probation officer as directed, follow all recommendations of the comprehensive assessment completed by Martin County Human Services, complete a diagnostic assessment with an approved provider and follow all recommendations, successfully complete domestic violence programming with an approved provider and follow all recommendations, participate in cognitive skills programming as directed by the probation agent, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, submit to random testing as directed, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives.
Hayden J. Ammann, 27, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel and if already completed then provide proof of completion to court administration. Additional charges of fourth-degree driving while impaired, and operate motor vehicle while under the influence of alcohol, were both dismissed.
Janet E. Presler, 58, of Truman was convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one unsupervised probation, don’t enter the Fairmont Walmart for six months, no same or similar.
Chantelle M. Wegner, 35, of Fairmont was convicted of theft-take/use/transfer movable property without consent; fined $99, restitution $14, sentenced to jail 90 days, stayed 90 days for one year, one unsupervised probation, pay restitution, don’t enter the Fairmont Walmart for six months, no same or similar.
