Alejandro Gauna, 30, of Jackson was convicted of third-degree driving while impaired-one aggravating factor; fined $815, sentenced to jail 364 days, stayed 361 days for two years, credit for time served three days, two years supervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations in a timely manner, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, only operate vehicles with ignition interlock system, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives if prohibited by law. Also convicted of possess open package of cannabis-non-compliant packaging; sentenced to jail three days, credit for time served three days, concurrent with other case. Additional charges of second-degree driving while impaired-two or more aggravating factors, cannabis use in motor vehicle on street or highway prohibited, and drive/operate/control motor vehicle without ignition interlock, were all dismissed.

Evan Fure, 20, of St. Cloud was convicted of theft-indifferent to owner rights; fined $160, sentenced to jail 91 days, credit for time served 91 days, restitution reserved for 60 days. Also convicted on a separate charge of theft-indifferent to owner rights; fined $75, sentenced to jail 91 days, credit for time served 91 days, restitution reserved for 90 days.

Justin L. Knight, 25, of Minnetonka was convicted of theft-take/use/transfer movable property without consent; fined $7,271.70, restitution $7,111.70, sentenced to jail 364 days, stayed 355 days for two years, credit for time served nine days, two years supervised probation, contact probation officer as directed, make minimum monthly restitution of $300 per month, complete a four-hour theft awareness course, cooperate with intrastate transfer if applicable, complete cognitive based programming as deemed appropriate by agent, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives if prohibited by law. Additional charges of driving after revocation, trespass-return to property within one year, and theft of motor fuel from retailer, were all dismissed.

Jose L. Moctezuma, 67, of Elmore was convicted of driving after suspension; fined $285. Also convicted of no insurance-driver violation; fined $200.
