Christian A. Arvizu, 26, of Fairmont was convicted of operate motor vehicle while under the influence of cannabis/hemp product; fined $510, sentenced to jail 90 days, stayed 90 days for one year, one year supervised probation, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel. Additional charges of fourth-degree driving while impaired, operate motor vehicle while under the influence of a controlled substance, and driving without a valid drivers license for vehicle class or type, were all dismissed.

Christopher J. Baer, 24, of Truman was convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for six months, six months unsupervised probation, remain law-abiding, no same or similar.

Coleton D. Bartz, 31, of Fairmont received a stay of adjudication on a charge of obstruct legal process-interfere with peace officer; fined $200, one year supervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 45 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing if requested by probation or law enforcement, no same or similar, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition or explosives. Additional charge of disorderly conduct-offensive/abusive/boisterous/noisy/obscene was dismissed.

Encarnacion Perez Perez, 27, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $710, sentenced to jail 90 days, stayed 90 days for one year, one year supervised probation, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel if there is one in Spanish. Additonal charges of fourth-degree driving while impaired, operate motor vehicle while under the influence of alcohol, and driving after revocation, were all dismissed.
