Lee A. Obernolte, 55, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $760, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 45 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel and provide proof of completion to court administration, complete booking and fingerprint process on or before 3/15/2024, no same or similar. Additional charges of fourth-degree driving while impaired, failure to stop for traffic control signal, operate motor vehicle while under the influence of alcohol and open bottle law-possession, were all dismissed.

Eggestein, 56, of Round Lake was convicted of second-degree driving while impaired-alcohol concentration 0.08 within two hours; fined $810, sentenced to jail 364 days, stayed 334 days for two years, serve 30 days on EHM with alco-sensor, work release is granted while on monitor, two years supervised probation, contact probation officer as directed, complete and pay for comprehensive assessment within 45 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing as requested by law enforcement or probation, complete post-sentence investigation if recommended by probation, attend MADD impact panel, no same or similar, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives. Additional charge of second-degree operate motor vehicle while under the influence of alcohol was dismissed.

Marri L. Kimmet, 66, of Fairmont was convicted of dog/cat at large-first offense; fined $135. Also convicted of dog/cat not licensed-first offense; fined $50.
