Joshua W. Clark, 48, of Blue Earth was convicted of second-degree driving while impaired-two or more aggravating factors; fined $615, sentenced to jail 364 days, stayed 274 days for two years, credit for time served four days, work release granted if meets jail qualifications, 30 days of jail should be served consecutively with the balance of 56 days on EHM with alcohol sensor at defendant’s expense, two years supervised probation, contact probation officer as directed, follow recommendations of the comprehensive assessment completed with Faribault County Human Services on 11/16/2023, complete the Drive With Care program offered through probation, no alcohol/controlled substance use with the exception of prescribed medications, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed. Additional charges of operate motor vehicle while under the influence of a controlled substance, driving after revocation and traffic collision-failure to notify owner of damaged property, were all dismissed.

Flanagan, 46, of Fairmont was convicted of reckless driving-drives consciously disregarding a substantial or unjustifiable risk; fined $285, sentenced to jail 90 days, stayed 86 days for one year, credit for time served four days, one year supervised probation, restitution reserved for 90 days, contact probation officer as directed, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations in a timely manner, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, random testing, attend MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed.
