Christopher A. Pourrier, 36, of Wells was convicted of disorderly conduct-offensive/abusive/boisterous/noisy/obscene; fined $260. Additional charge of obstruct legal process-interfere with peace officer was dismissed.

Kelby K. Johnson, 31, of New Richland was convicted of seat belt required-driver and passengers must use; fined $110. Also convicted of tires extending beyond fenders; fined $50.

Friederike R. Mortenson, 75, of Winnebago was convicted of speeding in specialzone set by Commissioners; fined $135. Additional charge of no proof of motor vehicle insurance was dismissed.

Speeding — Mary A. Hoffmeyer, 86, of Gruver, Iowa; fined $145.

Seat belt required-driver and passengers must use — Richard R. Sundberg, 30, of Welcome; fined $110.

Hands free law-engage in cellular phone or video call — Barry J. Sharp, 67, of Fairmont; fined $135.

Driving without a valid drivers license for vehicle class or type — Janelle I. Olabarrieta, 29, of Fairmont; fined $185.

Charson L. Anderson, 43 of Fairmont was convicted on a felony charge of predatory offender-knowingly commits act or fails to fulfill registration requirements; fined $185, commit to Commissioner of Corrections 365 days, give a DNA sample when directed. Also convicted of driving after cancellation; fined $285.

Jesse D. Lane, 45, of Mankato was convicted of theft-take/use/transfer movable property without consent; fined $40.27, restitution $40.27, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete booking within 30 days, pay restitution, do not enter the Fairmont Walmart, no same or similar. Additional charge of driving after cancellation was dismissed.

Joshua B. Smitherman, 42, of Sioux Falls, S.D. was convicted of driving while impaired-refuse to submit to chemical test; sentenced to jail 180 days, credit for time served 180 days, fine and surcharges are waived. Additional charges of operate motor vehicle while under the influence of alcohol and obstruct legal process-interfere with peace officer, were both dismissed.

Tomas J. Machado, 31, of Fairmont was convicted of domestic assault-commits act to cause fear of immediate bodily harm or death; fined $100, sentenced to jail 90 days, stayed 90 days for one year, one year supervised probation, contact probation officer as directed, complete booking within 30 days, successfully complete domestic violence programming as directed by probation agent, follow all recommendations of the comprehensive assessment being completed by Martin County Human Services, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, maintain compliance with child protection case, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charge of neglect of a child-likely substantial physical harm or emotional health was dismissed.
