Jon J. Gregory, 60, of Blue Earth was convicted of third-degree driving while impaired-one aggravating factor; fined $810, sentenced to jail 364 days, stayed 361 days for two years, credit for time served three days, two years supervised probation, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations in a timely manner, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no mood-altering chemicals including alcohol and THC, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, complete MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charges of fourth-degree driving while impaired, and expired drivers license-person over 21, were both dismissed.

Hector L. Nieves Giraud, 41, of Eden Prairie was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $410, sentenced to jail 90 days, stayed 87 days for one year, credit for time served three days, one year supervised probation, contact probation officer as directed, no alcohol/controlled substance use with the exception of prescribed medications including THC, no alcohol/controlled substance possession with the exception of prescribed medications including THC, random testing, follow all recommendations of the completed comprehensive assessment, complete MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charge of open bottle law-possession was dismissed.

Asa Tomita, 22, of Estherville, Iowa was convicted of failure to drive in single lane; fined $135. Also convicted of driver fails to yield right-of-way to emergency vehicle; fined $100.

Donovan E. Albrecht, 19, of Minnesota Lake received a stay of adjudication on a charge of third-degree damage to property-reduce value $501-$1,000; fined $75, sentenced to jail 180 days, stayed 175 days for one year, credit for time served five days, one year unsupervised probation, pay restitution if requested, no same or similar.

Laurie L. Brandenburg, 47, of Easton was convicted of third-degree driving while impaired-one aggravating factor; fined $620, sentenced to jail 364 days, stayed 362 days for two years, credit for time served two days, two years supervised probation, contact probation officer as directed, follow all recommendations of the comprehensive assessment completed 9/5/23, no alcohol/controlled substance use with the exception of prescribed medications including THC, no alcohol/controlled substance possession with the exception of prescribed medications including THC, random testing, complete the Driving with Care Level 2 program, attend MADD impact panel, complete cognitive-based programming with supervising agent if deemed appropriate, don’t enter bars, liquor stores or establishments where alcohol is the sole purpose of income unless approved by agent, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charge of driving after cancellation-inimical to public safety was dismissed.
