Samuel A. Clark, 40, of Viola, Wis. was convicted of operate motor vehicle while under the influence of a controlled substance; fined $660, sentenced to jail 90 days, stayed 82 days for one year, credit for time served eight days, one year unsupervised probation, complete and pay for comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, attend MADD impact panel, no same or similar. One additional felony charge of fifth-degree controlled substance possession-not small amount of marijuana, and three misdemeanor charges of possess over 1.4 grams of marijuana in motor vehicle, possess/sale small amount of marijuana-no remuneration, and possession of drug paraphernalia-use or possession prohibited, were all dismissed.

Chapa, 23, of Mankato received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $500, sentenced to jail three days, credit for time served three days, one year supervised probation, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives.

Emanuel J. Melendez Perez, 30, of Mountain Lake was convicted of reckless driving-drives consciously disregarding a substantial or unjustifiable risk; fined $3,338.36, restitution $3,238.36, sentenced to jail 90 days, stayed 76 days for one year, credit for time served 14 days, one year unsupervised probation, no misdemeanor moving violations or traffic-related offenses, no assaultive or threatening behavior, no contact with victim(s), no same or similar. Also convicted of disorderly conduct-brawling or fighting; sentenced to jail 90 days, stayed 76 days for one year, credit for time served 14 days, concurrent with two other cases, one year unsupervised probation, no misdemeanor moving violations or traffic-related offenses, no assaultive or threatening behavior, no contact with victim(s), no same or similar. Additional charges of fifth-degree assault-inflict or attempt bodily harm, driving after revocation, and driver who’s not owner must later produce proof of insurance if required, were all dismissed.
