Marvin C. Zehm, 53, of Ceylon was convicted on a felony charge of third-degree controlled substance possession-10 grams or more of a narcotic drug other than heroin; commit to Commissioner of Corrections 39 months, stayed for five years, sentenced to jail 90 days, credit for time served 10 days, may do sentence to service if eligible, five years supervised probation, sentence to service 20 days for indeterminate, contact probation officer as directed, complete diagnostic assessment, follow recommendations of most current comprehensive assessment including outpatient treatment and therapy, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, take medications in the prescribed dosage and frequency, remain law-abiding, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Also convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, commit to Commissioner of Corrections 17 months, stayed for five years, sentenced to jail 90 days, credit for time served three days, may do sentence to service if eligible, serve as work release if eligible, five years supervised probation, sentence to service 10 days for indeterminate, contact probation officer as directed, complete diagnostic assessment, follow recommendations of most current comprehensive assessment including outpatient treatment, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, take medications in the prescribed dosage and frequency, remain law-abiding, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charges of third-degree controlled substance possession in school/park/public housing zone, aiding and offender to avoid arrest-harbor/conceal, possess ammo/any firearm-conviction or adjudicated delinquent for crime of violence, and misdemeanor charges of possess ammo/any firearm-user of controlled substance, introduce contraband-drugs and alcohol into jail/lockup/prison, obstruct legal process-interfere with peace officer and possession of drug paraphernalia-use or possession prohibited, were all dismissed.
Kurtis L. Lynch, 31, of Fairmont was convicted of traffic-driving without motorcycle endorsement; fined $135. Also convicted of speeding; fined $60.
Sagrick L. Grant, 27,of Fairmont was convicted of failure to stop at stip signs or stop lines at entrance to thru highway; fined $285. Additional charges of driving without a valid drivers license for vehicle class or type, and careless driving-operate any vehicle carelessly on street or highway, were both dismissed.
Jonathan M. Nelson, 40, of Granada was convicted of disorderly conduct-offensive/abusive/boisterous/noisy/obscene; fined $185, sentenced to jail 90 days, stayed 86 days for one year, credit for time served four days, one year unsupervised probation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no same or similar. Additional charge of fifth-degree assault-fear of bodily harm or death was dismissed.
